The trust is a legal mechanism established by Law No. 2007-211 of February 19, 2007 in France. It allows a person or a company, called the settlor, to temporarily transfer assets, rights, or securities to a trustee. These assets are placed into a separate estate, called the trust estate, which is completely distinct from that of the trustee.

Here, the trust agreement is signed by three parties: the beneficiary, holder of the debt, the settlor, debtor of the debt, and the trustee, responsible for ensuring the contract’s compliance.

At the conclusion of the trust, the profits or benefits generated within the trust estate are redistributed to the settlor or a third-party beneficiary, as applicable.
